Terms of Service
Last updated: January 2025
These terms govern your use of Vericoo. By creating an account or scanning a QR card, you agree to these terms.
1. Acceptance of terms
By accessing or using Vericoo (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
These terms apply to all users of the Service, including individual users, organisation administrators, and anyone who scans a QR code generated by the Service.
2. Description of service
Vericoo is a digital identity card platform that allows users to create QR-coded identity cards containing personal information such as medical details, emergency contacts, employment records, and other identity-related data. Cards are accessible by scanning the associated QR code.
The Service is also available to organisations ("Entities") who may issue cards to their users (employees, students, patients, etc.) and manage those cards through a business dashboard.
3. Account registration
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must be at least 13 years of age to create an account. If you are under 18, you confirm that you have parental or guardian consent to use the Service.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
4. Acceptable use
You agree to use the Service only for lawful purposes. You must not:
- Provide false, misleading, or fraudulent information on your identity cards
- Impersonate any person or entity
- Use the Service to create cards for individuals without their knowledge or consent
- Attempt to access accounts or data belonging to other users
- Scrape, crawl, or systematically download data from the Service
- Introduce viruses, malware, or other harmful code
- Use the Service in any way that could disable, overburden, or impair it
- Use the Service to store or distribute illegal content
5. Card data and accuracy
You are solely responsible for the accuracy and completeness of the information you enter on your identity cards. Vericoo does not verify the accuracy of any card data.
Medical information on Vericoo cards is provided for informational purposes in emergency situations. It is not a substitute for professional medical advice, diagnosis, or treatment. First responders and healthcare professionals should use their professional judgment and verify information through appropriate clinical channels.
Vericoo accepts no liability for decisions made based on information contained in a scanned card.
6. Privacy and data
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data and is incorporated into these Terms by reference.
You retain ownership of all personal data you enter into the Service. By using the Service, you grant Vericoo a limited, non-exclusive licence to store and display your data solely to provide the Service to you.
7. Organisation administrators
If you are an organisation administrator using the business features of the Service, you additionally agree to:
- Only issue cards to individuals who have consented to receive them
- Ensure that card data entered on behalf of users is accurate and authorised
- Maintain appropriate access controls for your organisation's admin accounts
- Comply with applicable data protection laws in your jurisdiction regarding the personal data of your users
- Promptly deactivate cards when individuals are no longer associated with your organisation
8. QR code scanning
Scanning a QR code generated by Vericoo does not require an account. By scanning a card, you acknowledge that:
- The scan event is logged (date, time, approximate location, device type) and shared with the cardholder
- You will use any information obtained solely for its intended purpose
- You will not attempt to collect, aggregate, or store information from scanned cards beyond what is necessary
9. Intellectual property
The Vericoo platform, including its design, code, trademarks, and content (excluding user-submitted card data), is owned by Vericoo and protected by intellectual property laws.
You may not copy, modify, distribute, or create derivative works of any part of the platform without our express written permission.
10. Service availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend access for maintenance, security updates, or circumstances beyond our control.
Given that some use cases involve emergency access to medical information, we recommend that critical health information also be available in a non-digital format (e.g. a printed card or medical alert bracelet) as a backup.
11. Limitation of liability
To the fullest extent permitted by law, Vericoo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.
In no event shall our total liability to you for all claims exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
12. Indemnification
You agree to indemnify and hold harmless Vericoo and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of the Service.
13. Termination
You may terminate your account at any time through your account settings. Upon deactivation, your cards become inaccessible immediately. Your data is retained for 90 days in case you wish to reactivate, then permanently deleted.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will give reasonable notice where possible.
14. Changes to these terms
We may update these Terms from time to time. We will notify registered users of material changes via email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Vericoo is registered. Any disputes shall be resolved in the courts of that jurisdiction.
